The website naturaldermapet.it, hereinafter also the “Site”, is dedicated to the presentation and online sale of Natural Derma Pet brand products for the hygiene, care and well-being of dogs and cats.

Mennuti Group Distribuzione is hereinafter referred to as the “Seller”.

2. Scope of application

These General Conditions of Sale govern purchases made through the Site.

Before placing an order, the Customer is required to carefully read these Conditions. Submitting an order implies having read and accepted them.

The applicable Conditions are those published on the Site at the time the order is placed. The Customer can save or print them for safekeeping.

The protections provided by Legislative Decree no. 206 of 6 September 2005, "Consumer Code", apply exclusively to Customers acting as consumers, i.e., natural persons purchasing for purposes outside of their business, commercial, artisanal, or professional activity.

The provisions of the Civil Code and the specific clauses of these Conditions relating to professional customers apply to Customers who purchase within the scope of their professional or entrepreneurial activity.

3. Characteristics and destination of the products

The essential characteristics of the products are described on the relevant pages of the Site.

Before purchasing and using the product, the Customer is required to read the product description, ingredients, intended use, quantities, warnings, and instructions for use shown in the product sheet and on the packaging.

Product images are for illustrative purposes only. Colors, proportions, packaging, labels, and other graphic elements may differ slightly from the delivered product, even as a result of updates made by the manufacturer, without this resulting in a change in the essential characteristics of the product.

The products sold on the Site are intended exclusively for the uses indicated in the relevant information sheets and on the packaging. They must be used according to the instructions, recommended quantities, and precautions indicated on the label.

The information on the Site is for informational and commercial purposes only and does not constitute diagnosis, prescription, or veterinary advice. The products should not be used as a substitute for veterinary treatments or medications, unless expressly indicated and authorized.

In the presence of pathologies, lesions, allergies, persistent irritations, unwanted reactions or doubts about the animal's condition, the Customer is invited to stop using the product and contact a veterinarian.

The Customer is responsible for verifying the suitability of the product with respect to the species, age, condition of the animal and the intended use.

The provisions of this article do not limit or exclude the Seller's liability under mandatory regulations regarding safety, compliance and product liability.

4. Product availability

Products can be purchased within the limits of available quantities.

The availability indication on the Site is updated regularly, but it may exceptionally happen that a product indicated as available is no longer available at the time of preparation of the order, for example due to simultaneous purchases, inventory errors or technical problems.

In the event of total or partial unavailability, the Seller will promptly inform the Customer.

The Customer may choose, when possible, between:

  • wait for restocking;
  • replace the product with another available product;
  • receive a refund for the unavailable product;
  • cancel the entire order, when the unavailable part constitutes an essential element of it.

Amounts relating to unavailable products will be refunded using, as a rule, the same payment method used for the purchase.

5. Prices

All prices are expressed in euros.

Prices for consumers include VAT.

Any shipping costs will be indicated separately before the order is placed. For orders over €30.00, shipping costs will not be added; the Seller will cover the shipping costs.

The Seller may change prices at any time. Changes do not apply to orders already properly submitted and accepted.

6. Purchase procedure

To make a purchase, the Customer selects the desired products, adds them to the cart and completes the checkout procedure by entering the required data.

Before sending the order, the Customer can check and correct any errors, change the products and quantities, verify the total price and find out the applicable shipping costs.

The order is transmitted by pressing the button that clearly indicates the obligation to pay.

By sending the order the Customer:

  1. makes a purchase proposal for the products in the cart;
  2. declares that the data entered is complete and correct;
  3. accept these Terms;
  4. undertakes to pay the total price indicated.

After placing the order, the Customer will receive a notification at the email address provided during the purchase.

Automatic receipt of the order confirms that the system has received the request, but does not necessarily imply definitive acceptance if unavailability, obvious errors, payment irregularities, or other causes that prevent the order from being executed arise.

The contract is considered concluded when the Customer receives confirmation of acceptance or processing of the order by the Seller.

The Seller retains information relating to orders for the period necessary to fulfill them and in compliance with fiscal, administrative and legal obligations.

7. Data provided by the Customer

The Customer guarantees that the personal, billing and delivery data provided during the purchase are true, complete and up-to-date.

The Seller is not responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete data communicated by the Customer.

The Customer who creates an account is responsible for the confidentiality of his/her credentials and of the operations carried out through his/her profile, except for unauthorized uses not attributable to the Customer.

8. Payments

Payment can be made by:

  • credit or debit card through the circuits available at checkout;
  • PayPal;
  • any additional methods shown on the Site before sending the order.

Payment transactions are handled by the respective payment service providers in accordance with their contractual conditions and security measures.

The Seller does not acquire or store complete payment card data, except as may be permitted and managed by the payment service provider.

In case of unauthorized, refused, canceled or incomplete payment, the order cannot be processed.

The Seller may suspend the execution of the order when the payment provider reports anomalies, disputes, suspicions of fraud or the need for further checks.

9. Billing

When required by law or requested by the Customer, the invoice is issued based on the data provided during the purchase.

Customers requiring an invoice must correctly enter all required information, including VAT number, tax code, recipient code, or certified email address, when placing the order.

After the invoice has been issued, it may not be possible to modify the tax information, except where permitted by law.

10. Shipping and delivery

The Seller delivers to the territories selectable during the checkout process.

For shipments to Italy, the Site normally indicates a delivery or shipment in approximately 1–2 business days. This information is an estimate and may vary depending on the destination, product availability, holiday periods, order volumes, and the courier's activity.

Shipping is indicated as free, in Italy, for orders of an amount equal to or greater than 30 euros.

For smaller orders and for shipments outside of Italy, any additional costs will be shown in the cart or checkout before confirming the purchase.

Delivery is made to the address indicated by the Customer.

The Customer is required to verify the accuracy of the address, the presence of the name on the intercom and any other information necessary for the courier.

In the absence of the recipient, the courier's return, storage, or storage procedures apply. Any costs resulting from an incorrect address, failed collection, or repeated delivery attempts attributable to the Customer may be charged, to the extent permitted by law.

Unless otherwise agreed, delivery to the consumer will in any case take place within the deadline established by applicable legislation.

11. Transfer of risk and verification of delivery

For purchases made by a consumer, the risk of loss or damage to the products passes to the Customer when the latter, or a person designated by the Customer other than the carrier, physically takes possession of the products.

Upon delivery, the Customer is invited to check:

  • the integrity of the package;
  • the absence of openings, tampering, crushing or leaks;
  • the correspondence between the number of packages delivered and that indicated in the transport documents;
  • the correspondence of the products received with those ordered.

In the presence of visible damage, the Customer is invited to accept the package with specific reservations, describing the damage found, and to contact the Seller as soon as possible, attaching photographs of the packaging and the products.

Failure to report immediately does not result in the loss of consumer rights under the law, but it could make it more difficult to ascertain whether the damage occurred during transport.

12. Consumer's right of withdrawal

The consumer has the right to withdraw from the contract, without giving any reason, within 14 days from the day you acquire physical possession of the products.

In the case of an order consisting of multiple products delivered separately, the term starts from the day on which the consumer acquires physical possession of the last product.

To exercise the right of withdrawal, the consumer must communicate his decision to the Seller by means of an explicit declaration before the deadline expires.

The right of withdrawal can be exercised:

  • by sending an email to info@mennutigroupdistribuzione.it;
  • via certified email to the address [INSERT PEC];
  • using the standard withdrawal form at the end of these Conditions.

It is appropriate to indicate in the communication:

  • name and surname of the Customer;
  • order number and date;
  • products subject to withdrawal;
  • email address used for the purchase;
  • date of receipt of the products.

When the withdrawal is exercised via the digital function of the Site, the Seller will promptly send the consumer a confirmation of receipt on a durable medium, containing the declaration received and the relevant date and time.

The right of withdrawal is considered exercised within the terms when the relevant communication is sent before the expiry of the 14-day period.

13. Return of products

After notifying the withdrawal, the consumer will be contacted by the Seller's staff who will determine the date, approximate time of collection, and the collection address. Collection will be made by express courier at the seller's expense within 14 days of the withdrawal notification.

The Customer is responsible for correctly preparing the return. 

Products must be returned complete with all packaging, accessories, and documentation received.

14. Exclusions from the right of withdrawal

The right of withdrawal is excluded in the cases provided by law.

In particular, the right of withdrawal cannot be exercised for the supply of sealed goods that are not suitable for return for hygiene or health protection reasons and which have been opened after delivery.

This exclusion may include, for example, cosmetic products, detergents, wipes, lotions, shampoos, pet hygiene products, or other products with a hygienic seal or protection, when such seal has been removed and the product cannot be put back on sale in compliance with hygiene and safety requirements.

The right of withdrawal remains exercisable when the product is still intact and sealed, unless otherwise excluded by law.

Withdrawal is also excluded for:

  • products made to measure or clearly personalized;
  • products that are at risk of deteriorating or expiring rapidly;
  • products which, after delivery, are inextricably mixed with other goods;
  • further hypotheses expressly provided for by Article 59 of the Consumer Code.

The exclusion of the right of withdrawal does not affect the Customer's rights in the presence of defective, damaged, incorrect or non-compliant products.

15. Refunds resulting from withdrawal

In the event of a valid exercise of the right of withdrawal, the Seller will refund the payments received for the returned products, including the standard delivery costs originally offered by the Seller.

The refund will be made without undue delay and in any case within 14 days from the day on which the Seller was informed of the decision to withdraw.

The Seller may withhold the refund until it has received the products back or until the consumer has demonstrated that he has sent them back, whichever situation occurs first.

The refund will be made using the same payment method used for the order, unless otherwise expressly agreed with the Customer and provided that the latter does not incur additional costs.

16. Incorrect, damaged or missing products

If the product is incorrect, damaged, accidentally opened during transport, or missing, the Customer must contact the Seller at info@mennutigroupdistribuzione.it, indicating the order number and attaching, where possible, photographs of the package and the product received.

After the necessary checks, the Seller may proceed, depending on the case, with the replacement, integration of the shipment, withdrawal of the product or refund.

When the error or damage is attributable to the Seller or to transport, the costs necessary for the return or replacement will not be charged to the consumer.

17. Legal guarantee of conformity

Products sold to consumers are covered by the legal guarantee of conformity provided for by the Consumer Code.

The Seller is responsible for any defects of conformity existing at the time of delivery which become apparent within two years of delivery of the product.

A product may be considered non-compliant, for example, when:

  • does not match the description or characteristics declared;
  • does not possess the qualities and performances that the consumer can reasonably expect;
  • it is not suitable for the use normally intended for products of the same type;
  • it is delivered damaged, altered or unusable for reasons not attributable to the Customer.

The warranty does not cover problems arising from:

  • improper or non-intended use;
  • failure to follow instructions or warnings;
  • storage in unsuitable conditions;
  • normal consumption of the product;
  • damage caused after delivery;
  • individual reactions not attributable to a product defect, without prejudice to the regulations on safety and product liability.

In the event of a lack of conformity, the consumer has the right to the remedies provided by law, free of charge.

Taking into account the nature of the product, the remedy may consist of replacement, a proportional reduction in price or, in the cases provided for by law, termination of the contract and reimbursement.

To request assistance, the consumer can write to info@mennutigroupdistribuzione.it, indicating the order number, the affected product, the defect found, and attaching any photographs.

The legal guarantee cannot be excluded or limited by these Conditions.

18. Professional clients

When the Customer purchases for purposes related to his or her business or professional activity, the provisions of the Consumer Code reserved for consumers, including the 14-day right of withdrawal, do not apply, unless otherwise agreed in writing with the Seller.

For professional customers, the guarantee provided by the Civil Code applies, to the extent permitted by law.

Any commercial conditions dedicated to distributors, resellers, groomers or other professional operators may be governed by separate agreements.

19. Promotions, discount codes and free products

Promotions, discount codes and freebies are subject to the conditions communicated from time to time on the Site.

Unless otherwise indicated:

  • discount codes are not convertible into cash;
  • cannot be used after the expiry date;
  • they cannot be combined with each other;
  • may be limited to certain products, users, or minimum amounts;
  • They cannot be applied retroactively to orders already completed.

In the event of partial withdrawal, the Seller may recalculate the value of the order and any discount applied, when the lack of one or more products results in the promotion not being met.

Any complimentary products associated with the purchase must be returned in the event of a total withdrawal. If they are not returned, their retail value may be deducted from the refund, to the extent permitted by law and provided this is clearly communicated to the Customer.

20. Order cancellation

The Customer may request cancellation of the order by promptly contacting the Seller.

The request may be accepted if the order has not yet been entrusted to the courier.

If the shipment has already taken place, the consumer may exercise the right of withdrawal according to the methods indicated in these Conditions.

The Seller may cancel an order before shipment in the event of:

  • product unavailability;
  • missed or irregular payment;
  • delivery data that is manifestly incomplete or unverifiable;
  • well-founded suspicion of fraud or misuse of means of payment;
  • obvious error relating to the price or essential characteristics of the offer;
  • objective impossibility of executing the order.

In the event of cancellation by the Seller, any sums already paid will be refunded without undue delay.

21. Responsibility

The Seller is responsible for the execution of the contract in accordance with the law.

Nothing in these Conditions excludes or limits the Seller's liability for fraud, gross negligence, personal injury, defective product, breach of legal warranty or other cases in which liability cannot be excluded by law.

The Seller is not responsible for delays or failures to perform due to causes beyond its reasonable control, such as natural events, strikes, government measures, transport interruptions, health emergencies, unforeseeable unavailability of raw materials or essential services, and widespread malfunctions of communication networks.

In such cases, the Seller will inform the Customer and take reasonable measures to limit the inconvenience.

22. Intellectual property

The Natural Derma Pet brand, text, images, logos, graphics, product sheets, and other content on the Site are protected by intellectual and industrial property laws.

You may not copy, reproduce, modify, distribute, or use the contents of the Site for commercial purposes without the prior authorization of the owner of the relevant rights.

23. Protection of personal data

The Customer's personal data is processed in compliance with applicable legislation on the protection of personal data.

To learn about the purposes, legal bases, retention periods, recipients, and rights of the interested party, the Customer can consult the Privacy Policy published on the Site.

The use of cookies and other tracking tools is governed by the Cookie Policy.

24. Communications and assistance

For information on orders, shipments, returns, products or these Conditions, the Customer can contact the Seller via:

The Seller will try to respond to requests within a reasonable time, taking into account the nature and urgency of the report.

25. Complaints and alternative dispute resolution

The Customer can submit a complaint by writing to info@mennutigroupdistribuzione.it and providing the information necessary to identify the order and the problem encountered.

The Seller will examine the complaint and communicate the outcome to the Customer within a reasonable time.

The consumer can also contact an alternative dispute resolution body, called ADR, registered in the lists established by Italian and European legislation.

If a complaint submitted directly by the consumer is not resolved, the Seller will provide, where required by law, information relating to the competent ADR body or bodies and will communicate whether it intends to avail itself of them.

The previous European ODR platform for online dispute resolution has been decommissioned and is no longer usable.

26. Applicable law and competent court

These Conditions and the contracts concluded through the Site are governed by Italian law.

For disputes with a consumer, the court of the consumer's place of residence or domicile has jurisdiction, when located within the territory of the State, in accordance with the applicable legislation.

For disputes with customers who do not have the status of consumers, the Court of Florence has exclusive jurisdiction, unless otherwise agreed in writing.

27. Partial nullity

If any provision of these Terms is held to be invalid, unenforceable or unenforceable, this shall not affect the validity of the remaining provisions.

The invalid or ineffective clause will be replaced, where possible, by the applicable legal provision or by a valid clause that achieves a purpose as close as possible to the original one.

28. Changes to the Conditions

The Seller may update these Conditions to adapt them to regulatory, organizational, technical or commercial changes.

The changes will be effective from the date of publication on the Site and will not apply retroactively to orders already completed.
